Terms of Service

These Terms of Service (the "Terms") govern your use of PromoTwin (the "Service"), operated by us ("we", "us"). By creating an account you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. What the Service is

PromoTwin is an automation tool. It helps you train an AI twin from photos you provide, discover trending short-form videos, and recreate those videos fronted by your AI twin. Generation and training run on our infrastructure and are included in your subscription.

2. Who can use it

You must be at least 18 years old.
You must provide accurate account information and keep your password secure. You are responsible for activity under your account.

3. Likeness and consent

This is the rule that matters most. You may only train, import, or use an AI twin based on a real person if that person is you, or an adult who has given you clear permission to use their likeness this way. You confirm this every time you train or import a twin, and that confirmation is a promise you are making to us.

Never upload photos of minors, or of anyone whose age you are not sure of.
Never create a twin from a public figure or celebrity, or from anyone who has not agreed.
We screen uploaded photos automatically and reject sets that appear to break these rules, but screening is a safety net, not a substitute for your consent obligations.
If someone withdraws their consent, you must stop using their twin and delete it.

4. Source videos, rights, and your responsibility

Every recreation starts from someone else's video. Each time you add a creator to your watch list or start a recreation, you confirm that you have that creator's permission, or another legal right, to recreate the video. That confirmation is a representation you make to us. We record it, together with the exact wording you agreed to, and we rely on it to provide the Service.

You keep ownership of the photos you upload and the videos you generate. You grant us the limited rights needed to store and process them to run the Service.
Source videos belong to their creators. Recreating a video is your decision, and you are responsible for the recreations you make and for how and where you publish them, including compliance with the rules of any platform you post to.
A confirmation that turns out to be false is a breach of these Terms. You agree to indemnify us, which means you will cover our losses and reasonable legal costs, against any third-party claim that arises from a recreation you made or published, or from a false confirmation you gave us.
You may not use the Service to create content that is unlawful, that sexualizes minors in any form, that harasses or defames a real person, or that presents a real person doing or saying something they did not do without their consent.
Some platforms require AI-generated content to be labeled. Following those rules when you post is your responsibility.

5. Takedowns and complaints

If you believe content generated through the Service uses your likeness without consent, or infringes your rights, follow the process on our takedown page or email [email protected] with a link or description of the content and evidence of your identity or ownership. We review every report and will remove content and may suspend accounts where the complaint holds up. Accounts that repeatedly cause valid complaints are terminated.

6. Billing

Plans are monthly subscriptions billed through Stripe. Your plan renews automatically each month until you cancel.
You can cancel anytime from the billing portal in Settings. Cancellation takes effect at the end of the current billing period and you keep access until then.
Plan limits (a monthly credit allowance and the number of twins you can train) are enforced by the Service and described on the pricing page.
Your monthly plan credits reset at the start of each billing cycle; unused credits do not roll over. You can buy extra credits at any time, and purchased credits never expire.

7. Refunds

If the Service did not work for you because of a fault on our side, email [email protected] within 14 days of the charge and we will refund that month. Charges older than 14 days, and months where the Service worked as described, are generally not refundable, though you can always cancel future renewals.

8. Suspension and termination

We may suspend or terminate your account if you break these Terms, and will do so immediately for any violation of section 3 or the content rules in section 4. You can delete your account yourself at any time in Settings, or by emailing [email protected]. On termination we delete your data and media from our systems.

9. The Service is provided as is

We work hard to keep the Service reliable, but it depends on third parties we do not control, including our generation providers and the platforms videos are discovered from. The Service is provided "as is" and "as available", without warranties of any kind. Generated output quality varies and is not guaranteed.

10. Limitation of liability

To the fullest extent allowed by law, our total liability to you for any claim arising out of the Service is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect, incidental, or consequential damages.

11. Changes

We may update these Terms as the Service evolves. If a change is material we will notify you by email or in the app before it takes effect. Continuing to use the Service after a change takes effect means you accept it.
